Terms of use
1. Provider and acceptance
The Waylo app (the "app") is provided by Nemec s.r.o., Lieskové 449, 906 33 Cerová, company ID: 47030151, VAT ID: SK2023718994, Registered in the Commercial Register of the District Court Trnava, section Sro, entry no. 31154/T, https://heywaylo.com (the "provider"). Contact: support@heywaylo.com. By using the app or creating an account you agree to these terms. If you do not agree, do not use the app. Personal data is covered by the Privacy policy.
2. What the app does
Waylo uses your phone's location and its Bluetooth connection to your car (or, for a car without Bluetooth and only if you switch it on, your phone's movement) to record drives, and lets you prepare a logbook from them and export it to Excel. It is a tool to simplify record-keeping.
3. No advice, data may be inaccurate
- Records are generated automatically from GPS and phone sensors. They may be incomplete, inaccurate or wrong (for example because of weak GPS signal, a flat phone, Bluetooth switched off, system restrictions, a drive that was not recorded or was split incorrectly). A drive found by movement (a car without Bluetooth) may start a minute or two late, may end early or late, and may be a ride that was not yours (for example a bus or a taxi) that you have to delete; it also needs you to choose the car. Distances may differ from your vehicle's odometer.
- The odometer reading Waylo suggests or shows is only an estimate. It is calculated from the readings you entered and the recorded drives; drives that were not recorded are not in it. It may not match the real odometer.
- The provider does not guarantee that the logbook or an export meets the requirements of any tax, accounting, insurance, employment or other law (for example the income tax or VAT acts), or that any authority, employer or insurer will accept it.
- The app and its output are not tax, accounting or legal advice. For tax and record-keeping questions, consult a qualified tax advisor or accountant.
- You are solely responsible for checking, correcting and completing the data (including any odometer values you enter) and for how you use the data and exports, in particular in tax returns, deductions, expense claims and in dealings with authorities.
- Do not use data from the app as the sole evidence in any proceeding before an authority or court, or for other legal purposes, without checking it yourself.
4. Use at your own risk
You use the app at your own risk. Do not use your phone while driving. The app is not a navigation or safety tool and must not distract you from driving.
5. Account and your obligations
You must have legal capacity (or the consent of a legal guardian) and be at least 16. You are responsible for the accuracy of the data you enter and for keeping your credentials safe. You are responsible for everything done through your account; tell us if you suspect it has been misused.
6. Permitted and prohibited use
- You may use the app only in accordance with the law.
- Track only your own drives. If other people also use the car, or you provide it to employees or others, you must have their knowledge and any consent the law requires (for example when monitoring employees). You must not use the app to track other people secretly.
- In particular you must not overload the server, scrape data automatically, circumvent security, interfere with the app's operation, misuse other people's accounts or enter unlawful content.
7. Your data
Data you enter or that your drives create remains yours. You give the provider only the right to process it as needed to provide the app. You can export your data and delete your account at any time.
8. Licence and intellectual property
You receive a personal, non-exclusive, non-transferable, revocable licence to use the app for your own needs. The app, its name Waylo, its logo and its content belong to the provider or its licensors. You may not copy, modify, reverse engineer (except where the law allows) or redistribute them. Open-source components are covered by their own licences (see Licences in the app).
9. Third-party services
The app relies on third-party services, in particular Google Play, Firebase and Google Sign-In, Cloudflare, Aiven and OpenStreetMap map data. Their own terms apply. The provider is not responsible for their outages or conduct. Google is not a party to these terms and has no obligation to support the app.
10. Free version, free trial and Waylo Pro
- Free version. The app records your drives and sends them to your account, and shows the totals of each calendar month and your newest drive. Showing every earlier drive, filters and any date range, merging and splitting drives, deleting older drives and the Excel export need full access (a running free trial, a Waylo Pro subscription or access we have granted you).
- Free trial. A new account can start one free trial of 14 days, once per person. It needs no payment details, charges nothing and ends by itself; it does not turn into a subscription. To make sure the trial is used only once, we keep a coded reference of the account and of its email address for 24 months, even if you later delete the account (see the Privacy policy). When the trial ends you stay on the free version, or you subscribe to Waylo Pro.
- Waylo Pro. A paid subscription, monthly or yearly, bought through Google Play at the price shown there. It renews automatically until you cancel it, in the app or in Google Play, and is charged to your Google Play account. After you cancel, Pro stays until the end of the period you paid for. You can cancel at any time. Refunds follow Google Play's rules and mandatory law.
- Your drives stay yours. A drive is recorded and kept whether or not you have full access. When full access ends, nothing is deleted: the drives are there, and you see them again as soon as you have full access.
- We may change the price or the scope of Waylo Pro; a change to a running subscription follows Google Play's rules and takes effect at its next renewal after we tell you.
11. Availability, test versions and changes
The app is provided as it is. We do not guarantee uninterrupted availability or that it is error-free. We may change, limit or discontinue it. Test (beta) versions may contain errors and can cause data loss, so export important data regularly. We provide support by email on a best-effort basis.
12. Disclaimer of warranties
To the fullest extent permitted by law, the app is provided "as is" and "as available", without warranties of any kind, including of accuracy, completeness, fitness for a particular purpose or compliance with any law.
13. Limitation of liability
To the fullest extent permitted by law, the provider is not liable for indirect, consequential or incidental damages, lost profits, loss of data, loss of tax deductions, fines, penalties, additional taxes assessed or any other consequences arising from the use of data or exports from the app. The provider's total liability is limited to the amount you paid for the app in the previous 12 months (EUR 0 for free use).
Nothing in these terms excludes or limits liability that cannot be excluded or limited under mandatory law (in particular for intent, gross negligence or personal injury), or any consumer right you have under mandatory law.
14. Your responsibility
To the extent permitted by law, you are responsible for damage you cause the provider by breaching these terms or using the app unlawfully, including the reasonable costs of third-party claims that result. Against a consumer, this applies only to the extent mandatory law allows.
15. Force majeure
The provider is not liable for failing to perform because of events beyond its reasonable control, such as outages of the internet, power or third-party services, cyber attacks, orders of an authority or natural events.
16. Termination
You may stop using the app and delete your account in the app at any time (see Delete your account). The provider may suspend or end access if you breach these terms. Provisions that by their nature are meant to continue (in particular sections 3, 12, 13, 14 and 20) continue after termination.
17. Electronic communication
You agree that we send you notices electronically, in the app or by email to the address of your account, and that they count as delivered.
18. Changes to these terms
We may change these terms. The current version is always on this page with the date of its last update; we will tell you in the app about material changes. If you keep using the app after a change, you accept the new version.
19. General
If any provision proves invalid or unenforceable, the others remain in force and the invalid one is replaced by a valid one with the closest meaning. If we do not enforce a right immediately, we do not waive it. These terms together with the Privacy policy are the entire agreement between you and the provider about the app. The provider may transfer its rights and obligations under these terms to a successor; you may not transfer yours without our consent. No partnership or agency arises between us.
20. Governing law
These terms are governed by the law of the Slovak Republic. If you are a consumer, you keep the protection given by the mandatory law of the country where you live. A consumer may also turn to a body for alternative resolution of consumer disputes.
